Introduction

These terms apply to all sales of automotive parts by Wild Boar Fabrication. Placing an order indicates your acceptance of these terms.

 Orders

All orders are subject to availability and our written confirmation, and we reserve the right to cancel or reject any order.

 Use & Installation

All items must be installed correctly by qualified personnel, and we are not liable for the misuse or incorrect installation of any items.

 Rejection of Order

We reserve the right to accept or reject whole or part your order for any reason, acting reasonably. If we reject an order placed through the Site, we will endeavour to notify you of that rejection at the time you place the order or within a reasonable time after you submit your order.

 Cancellation of an order

Prior to the dispatch of an accepted order, we may cancel all or any part of that order without any liability to you, if  (a) the requested products are not available; or (b) there is an error in the price or the description posted on the Site in relation to a product; or (c) the order has been placed in breach of these terms and conditions.

We will endeavour to provide you with reasonable notice of any cancellation by us. We will not charge you for the cancelled order.

 Delivery & Risk

Delivery times are estimates only and any delays outside our control aren’t our responsibility. Risk transfers to you upon handing parts to your carrier or delivery address.

 Shipping

Our Shipping Policy applies to all orders placed via the Site and is incorporated into these terms and conditions by reference.

 Returns and Warranty

Our Returns Policy applies to all orders placed via the Site and is incorporated into these terms and conditions by reference. If purchased for business/trade use, you may contract out of the Consumer Guarantees Act, where fair and reasonable for both parties

 Prices & Payment

All prices are in NZD, inclusive of GST, and may change without notice.

 Limitation of Liability

Our liability is limited to the repair, replacement, or refund of any item up to the amount of the purchase price.

We exclude liability for indirect, special, or consequential losses.

 Force Majeure

We will not be responsible for any delay or failure to comply with our obligations under these terms of sale if the delay or failure arises from any cause which was beyond our reasonable control.

 Severability

Each of these terms and conditions is separately binding. If the whole or any part of a provision of these terms and conditions is void, unenforceable or illegal, then the remainder of the terms and conditions has full force and effect and the validity or enforceability of that provision in any other jurisdiction is not affected. This clause has no effect if the severance alters the basic nature of these terms and conditions or is contrary to public policy.

 Governing law

These terms and conditions are governed by the laws of New Zealand and are to be construed and enforced in accordance with those laws. Each party submits to the non-exclusive jurisdiction of New Zealand courts.
